Terms of service

These terms are a contract between you ("Customer") and UPSID SAS ("Nudje", "we", "us"), governing your use of the Service available at nudje.io and app.nudje.io. By creating an account you agree to these terms.

1. The Service

Nudje is a customer-intelligence and retention tool for SaaS companies. We surface moments that matter and turn them into ready-to-send messages your team can approve. We may add, modify, or remove features over time.

2. Accounts and workspaces

One person may create one or more workspaces. Each workspace has an owner who is accountable for billing and access control. You are responsible for all activity in your workspace, including the conduct of teammates you invite.

3. Acceptable use

  • No spam, phishing, or unsolicited bulk messaging via Nudje.
  • No use to harass or harm end users.
  • No reverse engineering or attempts to bypass rate limits.
  • No scraping or resale of the Service.

We may suspend a workspace that violates these rules.

4. Billing

Paid plans are billed monthly or yearly via Stripe. Charges renew automatically until cancelled. You can cancel anytime from Settings · Billing; access stays active until the end of the current billing period. We do not refund the unused portion of a paid period.

Actions consumed beyond your plan quota on Pro or Scale are billed at the metered rate published on /pricing. You can set a monthly overage cap to control spend.

5. Customer data

You retain all rights to the data you stream into Nudje on behalf of your own users. We process that data on your behalf to provide the Service. We do not sell it. We do not use it to train third-party AI models. See the privacy policy for details on sub-processors and retention.

6. AI features

Nudje uses AI to draft messages and compute insights. AI output is generated; you remain responsible for reviewing it before any message goes out to your end users.

7. Availability

We aim for high availability but do not guarantee an SLA on the Free plan. Pro and Scale customers can request scheduled-maintenance notices via email.

8. Termination

You can delete your account at any time from Settings · Profile. We will remove your customer data within 30 days of deletion. We may terminate accounts that breach these terms or accumulate unpaid charges.

9. Limitation of liability

To the maximum extent permitted by law, our aggregate liability for any claim under these terms is capped at the amount you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

10. Governing law

These terms are governed by French law. Disputes will be brought before the competent courts of Paris, France.

11. Changes

We may update these terms when our Service changes. We will notify workspace owners by email at least 30 days before a material change takes effect.
